Terms & Conditions

1. Definitions

1. Programmes: All training, coaching, and learning experiences we provide, whether purchased individually or bundled, including but not limited to the Well‑Paid BA Programme, BCS exam preparation courses, workshops, events, and any future offerings.
2. Materials: Any programme-related resources we provide (e.g., videos, slides, templates, workbooks, recordings) made available to you as part of your access.
3. Platforms: Any websites, learning portals, communication tools, or third‑party services used to deliver Programmes (e.g., Zoom, Teams, LMS, community platforms, payment processors).
4. Policies: These Terms, our Privacy Policy, and our Cookie Policy, as updated from time to time.
5. Bonus Access: Complimentary access to additional products (e.g., BCS exam preparation modules) provided at our discretion as part of certain purchases; scope and duration may change.

2. General Provisions

1. Your purchase and/or use of any Programme constitutes acceptance of these Terms.
2. These Terms form the entire agreement between you and us, superseding any prior statements or understandings relating to our Programmes.
3. We may collect usage and engagement data to operate, secure, and improve our Programmes. See our Privacy Policy for details.
4. You must be at least 18 years old to purchase or access our Programmes.
5. You shall not use our Programmes for any unlawful purpose or in breach of these Terms.

3. Access & Delivery

1. Programmes may include: (a) on‑demand modules; (b) templates/resources; (c) case studies; (d) live group coaching; (e) community access; and (f) a defined access period (typically six (6) months for core Materials from purchase), as described at checkout.
2. Where applicable, live group coaching access is typically provided for up to six (6) months from purchase; details will be stated on the sales page or checkout.
3. No Pause/Deferral: Programmes are structured; we do not permit pausing, deferring, or suspending enrolment. You are expected to complete within your access period.
4. Bonus Access: Complimentary access (e.g., to BCS exam preparation) is discretionary, may differ by offer, and can be modified or withdrawn without affecting the core value of your purchased Programme.
5. We may update, replace, or improve Materials to keep them current and useful. Format or feature changes do not reduce value if core outcomes remain reasonably achievable.
6. Extensions beyond the stated access period may be available for a continuation/renewal fee, at our discretion.

4. Payment Terms

1. You may pay in full or via an agreed instalment plan (e.g., two or three payments unless otherwise stated).
2. By selecting an instalment plan, you acknowledge and agree that you are entering into a legally binding agreement to pay the full Programme fee, not a subscription or pay-as-you-go service.
3. The instalment plan is provided solely as a convenience to spread the cost. It does not change your obligation to pay the full Programme price.
4. All instalments remain due and payable regardless of your level of participation, usage, or completion of the Programme.
5. Failure to complete payments does not cancel your obligation to pay the remaining balance.
6. Late, failed, or reversed payments may result in suspension or termination of access without refund, and we reserve the right to recover any outstanding balance.
7. Prices include/exclude applicable taxes as shown at checkout; you are responsible for any applicable taxes.
8. Chargebacks: Do not initiate a chargeback without first contacting support@businessanalystschool.com to attempt resolution. We reserve the right to dispute and recover costs arising from unjustified chargebacks.

5. Refund & Cancellation Policy

By enrolling in any Programme, you agree to this Refund & Cancellation Policy alongside our Terms and Privacy Policy.

5.0 Nature of the Programme (Important)

1. All Programmes are sold as complete training programmes with a fixed total price, not as subscriptions.
2. Where a payment plan is selected, this is a payment arrangement only and does not create a subscription or cancellable service.
3. By enrolling, you commit to the full Programme fee regardless of usage, attendance, or completion.

5.1 Cooling-Off Period

1. You may request a refund within 14 days of purchase provided you have not accessed any part of the Programme or downloaded any Materials.
2. By accessing any digital content, live sessions, recordings, templates, or Materials within this 14-day period, you expressly acknowledge and agree that the service has begun and your statutory cooling-off right is waived to the extent permitted by law.
3. If you wish to retain your 14-day cooling-off right, you must refrain from accessing the Programme until you have confirmed your decision to proceed.
4. No refunds are available after 14 days or once any part of the Programme has been accessed.

5.2 Live Group Coaching / Instructor-Led Sessions

1. You may request a refund within 14 days of purchase if you have not attended any live sessions and have not accessed any related Materials.
2. Once you attend any live session or access recordings, you acknowledge that the cooling-off right no longer applies, as the service has been supplied in full or in part.
3. No refunds are available after 14 days or once any session has been attended.

5.3 In-Person Training Events (if offered)

1. If we cancel due to insufficient enrolments, trainer illness, or force majeure, we will either:
   1. Refund 100% of the course fee if your purchase was within 14 days, or
   2. Reschedule you to a future date at no extra cost if your purchase was made more than 14 days before cancellation.
   We are not responsible for personal costs such as travel or accommodation.
2. If you cancel:
   1. 14 days or more before the event: 10% of the fee is retained as an administration charge; the balance is refunded.
   2. Within 10 business days of the event: no refund.

5.4 Non-Attendance

1. No refunds or credits are provided for missed sessions or non-attendance without a valid cancellation under the terms above.

5.5 No Partial Refunds

1. We do not offer partial refunds for unused time, missed sessions, lack of participation, or where you choose not to continue with the Programme.
2. Once access has been granted, the Programme is considered delivered in part or in full.

5.6 Financial Circumstances

1. Changes in personal, financial, or professional circumstances do not entitle you to a refund.
2. By enrolling, you accept responsibility for your financial commitment to the Programme.

5.7 How to Request

1. Email support@businessanalystschool.com with your name, purchase email, and reason for your request. Approved refunds (where applicable) will be processed within 14 working days to the original payment method.

This policy does not affect your statutory rights.

7. Intellectual Property

1. All Materials are owned by us or our licensors and protected by intellectual property laws.
2. We grant you a personal, non‑transferable, non‑exclusive licence to access and use the Materials for your own learning during your access period.
3. Reproducing, sharing, selling, sublicensing, publishing, or making Materials available to non‑clients is prohibited without prior written consent.
4. Recording live sessions or redistributing our recordings requires written permission.

8. Confidentiality & Conduct

1. Treat other participants’ information and any non‑public Programme details as confidential. Do not disclose without consent.
2. Maintain respectful, professional conduct. Harassment, discrimination, spamming, or disruptive behaviour may result in removal without refund.
3. You must not upload or transmit content that is unlawful, defamatory, obscene, infringing, or contains malware.

9. Accounts, Security & Acceptable Use

1. You are responsible for safeguarding your account, devices, and passwords, and for all activity under your credentials.
2. Single‑user licence: do not share logins or simultaneous access with others.
3. We may audit access patterns to prevent abuse and protect our Programmes.

10. Third‑Party Tools & Links

1. Programmes may integrate third‑party tools or link to external sites. We do not control and are not responsible for third‑party content, policies, or availability.
2. Your use of third‑party tools is subject to their own terms and privacy notices.

11. Disclaimers & Limitation of Liability

1. Programmes and Materials are provided on an “as is” and “as available” basis. We do not guarantee specific job, income, or outcome results.
2. We do not warrant uninterrupted or error‑free access, or immediate correction of defects.
3. To the fullest extent permitted by law, we exclude all implied warranties and shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profit, data, goodwill, or opportunities.
4. Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be limited.

12. Indemnity

1. You agree to indemnify and hold harmless Business Analyst School Ltd, its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of our Programmes.

13. Force Majeure

1. We will not be liable for any delay or failure to perform due to causes beyond our reasonable control, including outages, cyber incidents, strikes, civil unrest, acts of God, epidemic/pandemic, or governmental action.

14. Suspension & Termination

1. We may suspend or terminate your access (without refund) if you breach these Terms or engage in misconduct.
2. On termination, your licence to use Materials ceases and you must stop using and delete any downloaded items (unless otherwise required by law).

15. Changes to these Terms

1. We may update these Terms from time to time. We will post changes on this page and/or notify you by email.
2. Changes take effect 24 hours after posting unless stated otherwise. Continued use of any Programme after changes means you accept the updated Terms.

16. Severability & Waiver

1. If any provision is found invalid or unenforceable, the remainder remains in full force and effect.
2. Failure to enforce any right is not a waiver of that right or any other.

17. Governing Law & Jurisdiction

1. These Terms and any dispute or claim (including non‑contractual disputes) are governed by the laws of England and Wales.
2. The courts of England and Wales shall have exclusive jurisdiction.
3. If you are a UK consumer, these Terms do not affect your statutory rights.
